Terms of Service

Effective date: March 9, 2026

These Terms of Service ("Terms") govern your use of the Der Artikel mobile application ("Application"), created by yapps Studio ("Service Provider"). By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.

1. License

The Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes in accordance with these Terms.

2. Apple Standard End-User License Agreement (EULA)

If you downloaded the Application from the Apple App Store, you acknowledge and agree that these Terms are between you and the Service Provider only, and not with Apple Inc. ("Apple"). The use of the Application is additionally governed by the terms set forth in Apple's Standard End-User License Agreement (EULA), available at apple.com/legal. In the event of any conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA shall take precedence with respect to your use of the Application obtained through the Apple App Store.

You also acknowledge that Apple has no obligation to provide any maintenance or support services with respect to the Application.

3. In-App Purchases and Subscriptions

The Application may offer in-app purchases or auto-renewing subscriptions ("Premium Features"). If you choose to purchase Premium Features, the following terms apply:

• Payment will be charged to your Apple ID (or Google Play) account at confirmation of purchase.
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified.
• Subscriptions may be managed by the user, and auto-renewal may be turned off by going to the user's Account Settings after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

All purchases are processed through the respective app store and are subject to the store's terms and conditions. All payments are non-refundable except as required by applicable law or as provided by the respective app store's refund policies.

4. Acceptable Use

You agree not to:

• Use the Application for any unlawful or unauthorized purpose;
• Modify, adapt, translate, reverse-engineer, decompile, or disassemble the Application;
• Remove or alter any proprietary notices, labels, or marks from the Application;
• Distribute, sublicense, lease, rent, or lend the Application to any third party;
• Use the Application in any way that could damage, disable, or impair its functionality.

5. Intellectual Property

All intellectual property rights in the Application, including but not limited to text, graphics, logos, and software, are owned by or licensed to the Service Provider. You may not reproduce, distribute, or create derivative works based on the Application without the Service Provider's prior written consent.

6. Third-Party Services

The Application may use third-party services that have their own terms and conditions:

• Google Play Services
• AdMob

7. Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. The Service Provider does not warrant that the Application will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Application.

9. Termination

The Service Provider may terminate or suspend your access to the Application at any time, without prior notice, for any reason, including if you breach these Terms. Upon termination, your license to use the Application will cease immediately.

10. Changes to These Terms

The Service Provider reserves the right to modify these Terms at any time. Updated Terms will be posted within the Application or on the Service Provider's website. Your continued use of the Application after any changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
